2. Role as Intermediary
Family Elite Divers acts solely as an independent intermediary platform connecting clients with professional dive centers worldwide.
Family Elite Divers:
Does not operate diving activities
Does not employ instructors or dive staff
Does not own or operate boats or diving equipment
Does not organize activities directly
All diving services are provided and operated exclusively by the selected dive center, which acts as an independent service provider under its local laws and regulations.
3. Responsibility of Dive Centers
Each dive center is solely responsible for:
Safety standards and procedures
Staff qualifications and certifications
Diving operations and logistics
Boats, equipment, and facilities
Required licenses and permits
Compliance with local regulations
Participant insurance requirements
Clients agree to comply with the specific terms, safety rules, and operational decisions of the selected dive center.
4. Limitation of Liability
Family Elite Divers shall not be held liable for:
Accidents, injuries, or incidents occurring during activities
Weather conditions or natural events affecting operations
Operational cancellations or schedule changes by dive centers
Flight delays, travel disruptions, or lost baggage
Local health issues or medical emergencies
Decisions made by local authorities
Force majeure events beyond reasonable control
Participation in diving activities is undertaken at the client’s own risk.
5. Medical Fitness
Clients must ensure they are medically fit to participate in diving activities.
A medical self-assessment may be required prior to participation.
A medical certificate may be required depending on local regulations or dive center policies.
Failure to disclose relevant medical information may result in denial of participation without refund.
6. Certification and Insurance
Certified divers must present a valid certification from a recognized international diving agency.
All certified divers must hold valid international diving insurance covering:
Diving accidents
Emergency evacuation and medical transport
Civil liability to third parties
Participation may be denied without valid certification or insurance. Insurance may be purchased locally if available.
7. Equipment Responsibility
Clients are responsible for proper use of any rented equipment. Lost or damaged equipment may be subject to repair or replacement charges determined by the dive center.
8. eLearning Courses
For courses including online academic modules, all theory must be completed prior to arrival. Failure to complete required coursework may result in rescheduling.
9. Course Duration
Course durations published on the website represent minimum or standard completion times. Certification is granted only after all performance requirements are successfully completed.
10. Types of Booking
Planned Booking
For clients organizing travel in advance who require guaranteed dates.
Flexible / On-Demand Booking
For clients already at destination seeking availability in the coming days.
Availability depends entirely on the dive center.
11. Payments and Refunds
Payments are securely processed via Stripe using certified payment infrastructure.
Family Elite Divers uses a marketplace payment system where:
Clients make a single payment
Funds are automatically distributed between the dive center and Family Elite Divers as a service commission
Refunds are processed according to the cancellation policy applicable to each booking.
Service and platform fees may be non-refundable.
Refund processing times may vary depending on financial institutions and international banking systems.
12. Cancellation Policy
Cancellation terms depend on booking type and are displayed at the time of reservation.
Refunds may be full, partial, or unavailable depending on notice period.
Date changes may be subject to availability and provider approval.
13. Force Majeure
Family Elite Divers shall not be liable for cancellations, changes, or service disruptions caused by events beyond reasonable control, including but not limited to:
Severe weather events
Natural disasters
Government restrictions
Border closures
Airline strikes
Political instability
Health emergencies or pandemics
Such events may affect refund eligibility.
14. Third-Party Provider Terms
Each dive center operates under its own terms, policies, safety standards, and local regulations.
By confirming a booking, the client acknowledges and accepts that all activities are carried out under the general conditions of our partner dive centers, which operate in accordance with local regulations and best practices in recreational diving.
15. Data Protection and Privacy
Personal data is processed solely for booking management and customer communication.
Data is handled in accordance with applicable international privacy regulations, including GDPR where applicable.
Data is not sold or shared with unauthorized third parties.
16. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of the country of residence of the Responsible Party.
Any disputes arising shall be subject to the jurisdiction of the competent courts of that location.
17. Acceptance of Terms
By using this website and making a booking, clients acknowledge that they have read, understood, and agreed to these Terms and Conditions.
